What you will find are the general assault offences, and the word \u00abdomestic\u00bb describes the domestic relationship between the accused and the complainant, not a distinct crime.<\/span><\/p> <p><span style=\"font-weight: 400;\">The domestic context does not make an assault charge lighter. It captures an attempt or a threat, by act or gesture, to apply force, where the other person reasonably believes you have the ability to carry out that threat.<\/span><\/p> <p><span style=\"font-weight: 400;\">Three elements follow from that wording.\u00a0<\/span><\/p> <ol> <li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No bodily harm is required, so a grab, a shove, or a blocked doorway can meet the definition of assault.\u00a0<\/span><\/li> <li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consent is the dividing line, because force applied without consent is what makes contact criminal.\u00a0<\/span><\/li> <li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The act must be intentional, which is why intent is so often the live issue in domestic assault cases.<\/span><\/li> <\/ol> <p><span style=\"font-weight: 400;\">Because the threshold for an assault charge is low, one heated evening can produce a criminal charge that carries lifelong consequences.<\/span><\/p> <h3><span style=\"font-weight: 400;\">Which Relationships Make an Assault Charge Domestic<\/span><\/h3> <p><span style=\"font-weight: 400;\">An ordinary assault charge becomes a domestic assault file based on one thing: the relationship between the accused and the complainant. It is a hybrid offence, meaning the Crown elects to proceed by summary conviction, with a maximum of two years less a day, or by indictment, with a maximum of five years imprisonment.<\/span><\/p> <p><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/section-267.html\"><span style=\"font-weight: 400;\">Section 267<\/span><\/a><span style=\"font-weight: 400;\"> covers two more serious variations of assault. The first is <\/span><a href=\"https:\/\/frouharlaw.com\/our-expertise\/assaults\/assault-with-a-weapon\/\"><span style=\"font-weight: 400;\">assault with a weapon<\/span><\/a><span style=\"font-weight: 400;\">, and courts read \u00abweapon\u00bb broadly, so a thrown phone or a kitchen object qualifies. The second is <\/span><a href=\"https:\/\/frouharlaw.com\/our-expertise\/assaults\/assault-cause-bodily-harm\/\"><span style=\"font-weight: 400;\">assault causing bodily harm<\/span><\/a><span style=\"font-weight: 400;\">, where the complainant suffers bodily harm that is more than trifling or transient.<\/span><\/p> <p><span style=\"font-weight: 400;\">Section 267 also captures choking, suffocating and strangling an intimate partner. All three assault charges carry a maximum of ten years imprisonment on indictment.<\/span><\/p> <h3><span style=\"font-weight: 400;\">Aggravated Assault (<\/span><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/section-268.html\"><span style=\"font-weight: 400;\">Section 268<\/span><\/a><span style=\"font-weight: 400;\">), Uttering Threats and Criminal Harassment<\/span><\/h3> <p><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/section-268.html\"><span style=\"font-weight: 400;\">Section 268<\/span><\/a><span style=\"font-weight: 400;\"> defines <\/span><a href=\"https:\/\/frouharlaw.com\/our-expertise\/assaults\/aggravated-assault\/\"><span style=\"font-weight: 400;\">aggravated assault charges<\/span><\/a><span style=\"font-weight: 400;\"> as an assault that wounds, maims, disfigures or endangers life. Independent witnesses are rare, so the evidence is one account against another, supported by 911 calls, text messages, witness statements, photographs, or medical records. Where officers have reasonable grounds to believe an assault occurred, they lay a charge regardless of what the parties want. A conviction can render a permanent resident inadmissible to Canada, and travel to the United States can be refused on the strength of the criminal record alone.
