Crown disclosure is the raw material of a case: police notes, witness statements, video, forensic reports, the officer's grounds for arrest. We read all of it, then we read what is missing.

Gaps matter. A missing booking video, or a delay between arrest and breath sample, gives your defence lawyer something to argue.

The Canadian Charter of Rights and Freedoms limits what police may do. An arrest without reasonable grounds, a search beyond the warrant, a denied right to counsel: each supports a Charter motion asking the court to exclude the evidence that flowed from the breach. Unlawful search and seizure and improperly authorised wiretaps fall under the same analysis, and evidence excluded under section 24(2) often ends the prosecution.

Bail comes first. Judicial interim release is decided within hours of arrest, and the plan you bring matters more than the speech your lawyer gives: a named surety, a fixed address, realistic conditions.
